Welcome to the bottlesandbarrels.ca website, which is run by Bottles& Barrels Inc. (referred to as the "Company," "we," "us," or "our" in this document).

PLEASE NOTE THAT THE TERMS ("TERMS OF SERVICE") BELOW, WHICH CONSTITUTE AN AGREEMENT BETWEEN USERS OF THE WEBSITE AND BOTTLESANDBARRES.CA (THIS "AGREEMENT"), APPLIES TO YOUR USE OF THE WEBSITE. The terms of service may be updated by bottlesandbarrels.ca from time to time with or without notice to you. Your continued use of the website indicates acceptance of any changes to the terms of service. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS OF SERVICE, DO NOT ACCESS OR OTHERWISE USE THE WEBSITE OR ANY INFORMATION OR MATERIALS CONTAINED ON THE WEBSITE.


The Way We Work

The company operates as "bottlesandbarrels.ca" to the public and holds a License to Represent the Manufacturers issued by the Alcohol and Gaming Commission of Ontario (the "AGCO") for its representation of each producer shown on the website. Alcohol acquired under the Consignment Program run by the Liquor Control Board of Ontario ("LCBO")'s Specialty Service is offered for sale and delivered to you; we or our affiliates are approved by the LCBO as consignment agents.

The LCBO's standards and our duties are outlined in the LCBO Guidelines. We do not "sell" wine as a Manufacturer's Representative or agency. Instead, the LCBO sees you as a customer. We act as the middleman in the sale of wine from the LCBO to you. "Processes" refers to the way we represent our manufacturers and help you make your LCBO purchase. The Freedom of Information and Protection of Privacy Act applies to both the LCBO and bottlesandbarrels.ca in situations when the LCBO requests information from us in order to submit orders. Please contact bottlesandbarrels.ca if you ever believe the LCBO has utilised this information for something other than to complete a sale. You are under no need to react if the LCBO contacts you regarding your purchase history, but we do ask that you let us know right away.

The wine prices displayed on the website include the LCBO sale price, licensee markups and discounts, as well as any fees imposed by either B&B or bottlesandbarrels.ca. Upon request, the LCBO retail price is provided. Until your order is placed, the LCBO keeps all wine in its consignment warehouse. Other than pre-arranged pick-ups and items in transit, bottlesandbarrels.ca does not sell wine directly to customers and does not stock any alcoholic beverages on-site.


Usage Requirements

The selling of alcoholic beverages is strictly controlled. You are in charge of adhering to all laws that apply to buyers and drinkers, especially those that pertain to the shipment of alcoholic beverages. You will not make any demands that bottlesandbarrels.ca send alcohol outside of the Province of Ontario. While using the website, you agree to refrain from doing the following things:

purposefully or unintentionally break any applicable rule or regulation, such as offering to buy alcohol or creating a delivery plan on behalf of someone who isn't of legal drinking age. Aaccess, tamper with, or utilise the computers or nonpublic sections of the Website or bottlesandbarrels.ca. Unauthorised people who try to enter these locations or tamper with them could face legal action. Unless expressly authorised in writing by bottlesandbarrels.ca, you may not frame or link to the Website.


The Distribution of Alcoholic Drinks

Under-19-year-olds cannot purchase alcohol through bottlesandbarrels.ca. You certify that you are at least 19 years old by accessing this website. Every effort is made by bottlesandbarrels.ca to prevent the delivery of alcoholic beverages to anybody under the age of 19. You acknowledge that the person getting a shipment of alcoholic beverages from bottlesandbarrels.ca is at least 19 years old by accessing the website. You are not permitted to use the website if you disagree with these terms of use. Bottlesandbarrels.ca will notify the AGCO of the violation if you knowingly or unknowingly falsely declare your age in order to sell alcohol to a person under the age of 19. The AGCO may then pursue full legal action against you.

The delivery agent may decide to ask for proof of age upon delivery. Anyone who appears to be drunk will not have their alcohol deliveries completed by the delivery agent.

You are not allowed to sell wine unless you do it in compliance with AGCO rules. You may only do so under the terms of a liquor licence given by the AGCO if your objective is to sell wine for profit, whether for consumption or another purpose. You may only do so in accordance with a Special Occasion Permit ("SOP") issued by the AGCO if your intention is to sell wine for consumption or other purposes at sporadic special events only held outside of a residence (a "Sale SOP") or to provide for the consumption of wine at a public indoor or outdoor event (a "Non-Sale SOP"). When selling or providing for the consumption of wine under a liquor licence or SOP, you are responsible for the safety and sobriety of the attendees as well as for compliance with all applicable laws and regulations. IT IS ILLEGAL TO SELL WINE IN OR FROM A PRIVATE RESIDENCE.


Third-Party Monitoring and Content

Any viewpoints, recommendations, statements, actions, results, or other information or content expressed or made available by third parties (including information providers and users) through this website are theirs, not bottlesandbarrels.ca's. Any opinion, advice, information, or statement made on this website by a person other than an authorised representative of bottlesandbarrels.ca acting in their official capacities is not supported by B&B or bottlesandbarrels.ca, and neither are they responsible for the truthfulness or trustworthiness of any such content.

Privacy Guidelines and Password Security
